A class action lawsuit is pending in the Superior Court of Arizona, Maricopa County entitled In re Swift Transportation Co. Inc., CV2004-001777.
If you drove a truck for Swift Transportation Co. after March 6, 2001, as an owner-operator, or after April 9, 2009, as an employee, a class action lawsuit may affect your rights.
The Court has not decided whether Swift did anything wrong. There is no money available now and no guarantee there will be. Your legal rights are affected by this class action. You have a choice to make.
Mr. Garza and his attorneys must prove the claims against Swift. If money or benefits are obtained from Swift, and you do not exclude yourself from the class, you will be notified about how to obtain a share.
Currently there is no settlement or award and if one is obtained you will be notified.
On January 21, 2020, the Honorable Timothy J. Thomason decertified the class and granted Swift’s Motion for Summary Judgment. Judge Thomason also vacated the trial. Plaintiff Garza has 30 days from the entry of judgment to file an appeal to the Arizona Court of Appeals, and currently plans to do so. Plaintiff and his counsel, however, are evaluating the options, and will update this website with more information in the near future.
